Registration is the gate: a producer may not place packaging on the market without it, and the ZSVR publishes registered producers in the public LUCID register.
What "producer" means
Under VerpackG, the producer is the party that first places packaging filled with goods on the German market. The definition is functional, not geographic:
- A German manufacturer placing filled packaging on the market is a producer.
- A German importer bringing in filled packaging is a producer.
- A foreign seller shipping directly to German end consumers is a producer - this is the category CLK falls into for its direct German shipments.
The functional definition is why a factory in Jiangxi holds a German registration: the obligation follows the placement of packaging, not the location of the company.
The dual system model
Germany's system works through licensed collection schemes - the "dual systems" - funded by producer fees based on packaging material and quantity. After registration, the producer licenses its packaging volumes with one or more systems, and the system organises collection, sorting and recycling. The fee is calculated from real packaging data, which is why data reporting is part of the law.
Factory data: Our registration notice states the declarations that go with it: the application data is truthful, we did not use a third-party broker (the law prohibits brokers for registration), and we fulfil take-back obligations through system participation. Those three declarations are the legal core of the notice - and they are the same questions every producer into Germany must answer.
Why this matters for luggage
Every carton, poly bag and insert that ships with a suitcase into Germany is packaging under VerpackG. E-commerce parcels are shipping packaging; the retail box is sales packaging; the outer carton is outer packaging. For a brand selling luggage into Germany - directly or through a marketplace - the packaging compliance question is unavoidable, and it starts with the same two steps CLK took: register, then license.
