Why a Non EU Manufacturer Needs an EU Representative

    The direct answer

Under GPSR, a manufacturer not established in the EU must designate an EU-established economic operator before placing products on the EU market - an importer, an authorized representative, or in some cases a fulfilment service provider - and the authorized representative route is the document in CLK's folder. The appointment gives EU authorities a real entity to contact about the product, and it works alongside the importer's own obligations. For a factory selling directly into the EU, the EC REP is not optional paperwork; it is the answer to the question "who in the EU is responsible for this product being on the market?"

    The economic operator options

    Operator

    Who they are

    When they work

    ---+

    ---

    ---

    Importer

The EU business that imports and places the goods

When goods move through an EU importer

    Authorized representative

An EU entity formally appointed by the non-EU manufacturer

    The direct-sales route - CLK's case

    Fulfilment service provider

    An EU warehouse/logistics operator

    In limited, defined circumstances

The right option depends on the sales flow - not on preference. A factory shipping directly to EU consumers needs the authorized representative route; goods that pass through an EU importer are covered by the importer's economic-operator role.

    What the representative must do

The authorized representative's job is to be the reachable EU point for the manufacturer:

    • Provide the manufacturer's contact details to authorities on request.
    • Cooperate with market surveillance authorities.
    • Hold or access the manufacturer's contact information and relevant documentation.
    • Act as the communication channel for safety issues.

The representative does not take over the manufacturer's liability - the certificate for CLK's appointment says so directly: the manufacturer remains responsible for product-related disputes in the EU.

Factory data: When EU buyers see our EC REP certificate, the follow-up question is usually "does this cover my imports too?" The honest answer: our appointment covers CLK's placements; if you import and place the goods, GPSR obligations follow your economic-operator role as importer. The certificate is the factory's representation, and each party in the chain carries its own role.

The split that buyers must understand

Two parties can both have GPSR obligations in the same product flow:

    • CLK - as the non-EU manufacturer, must have an EU economic operator (done via EUREPSTAR) for its placements.
    • The EU buyer/importer - as the party importing and placing goods on the EU market, has its own manufacturer/importer duties.

Neither's documentation cancels the other's. The factory folder and the importer folder are separate layers of the same compliance picture.

    FAQ

Who must appoint an EU representative under GPSR?

Manufacturers not established in the EU that place products on the EU market - unless an importer or another qualifying economic operator covers the flow.

What is the difference between an importer and an authorized representative?

An importer buys and places goods in the EU as its own economic operation; an authorized representative is appointed by the non-EU manufacturer to be the EU point of contact. Both can exist in the same flow.

Does the EC REP take responsibility for my product?

No - the representative is the EU contact and documentation channel. The manufacturer remains responsible for product-related disputes, as CLK's certificate states.

Can a fulfilment service provider replace the authorized representative?

Only in defined circumstances under GPSR; the fulfilment provider route is limited compared with the importer or authorized representative options.

Why do marketplaces ask about the EU responsible person?

GPSR requires product listings to show the manufacturer's and the EU economic operator's contact information - which is why platforms collect and verify that data.

How do I know which route my products need?

Map the sales flow: who places the product on the EU market? Direct-sales manufacturers need the authorized representative route; importer-led flows use the importer's role.
